Copyright and Trademark Law

Aaron: Start us off with a little more background about you. I loved your story about your last name on your website, so maybe start there and just tell us a little more about you.

Terry: We received a lot of great questions from our listeners so we would like to get them answered in no particular order. Let’s start with… When is a free design not free?

Aaron: Sharing of designs and logos. What if I buy a design on the internet how do I know if I can use it and it has been stolen from elsewhere?

Terry: Can I take my local junior sports team logo or will I still need permission?

Aaron: Where does decorating for a private purpose stop being private and become commercial from a legal standpoint? (Samples etc.)

Terry: How is it that folks selling on ETSY appear to be selling Trademarked goods (Disney, Pro Sports, College, etc.) every day with impunity? The Internet appears to have made enforcement the Wild West. So what is and is not being enforced?

Aaron: How come Disney can use stories that are in the public domain for centuries and transform them and the characters in copyright material?

Terry:  We also got a question about fonts. the Disney font, Star Trek font, Star Wars font, etc. Can these be used to make their own logos and designs?

Aaron: When a designer and the customer are working together on an art project, who owns the art? The designer, the customer or the company paying the designer for their time?

Terry: How do you go about getting a design/saying that goes along with your brand copyrighted? Finding a trademark lawyer? What do we need to do on our end!?

Aaron: Where can people find your Podcast, your Law Practice and how can they put you on retainer?
